Family Digital Foundation — (Product Beta)

Welcome! These Terms of Service ("Terms") are an agreement between you and the Family Digital Foundation ("FDF," "we," "us"), a Virginia nonprofit corporation recognized as a 501(c)(3) public charity. They govern your use of a Family Identity Space (the "Product") during beta release.
We've tried to keep these Terms short and readable. Please read them — by creating an account or using the Product, you agree to them.
1. Who We Are
The Family Digital Foundation is a public charity building a private AI and digital home for families. Our mission is simple: technology owned by families, guided by wisdom, and designed for generations. The Product is offered in service of that mission — not to monetize you or your data.
2. The Beta Program
The Product is in beta. That means:
Features may change, break, or be removed without notice.
We may add, suspend, or delete accounts as we scale the program.
Data loss is possible, despite our best efforts. Please don't treat the Product as your only copy of anything important during beta.
We may contact you for feedback, and we appreciate it when you share it.
3. Family Accounts
The Product is organized around families, not individual users.
A family account must be created and administered by an adult (18 or older) — the "Family Administrator."
The Family Administrator may invite other family members, including children, and manages the family's settings, membership, and data.
Each member is responsible for keeping their own login credentials private.
You agree to provide accurate information when creating an account.
4. Children and Parental Consent
We designed the Product so children can participate safely as part of their family.
Children under 13 may use the Product only as members of a family account, with the verifiable consent of their parent or legal guardian, as required by the Children's Online Privacy Protection Act (COPPA).
The Family Administrator (parent or guardian) controls what a child can access, can review the child's information, and can delete it or withdraw consent at any time through the family account settings or by contacting us.
We collect no more information from children than is reasonably necessary for them to use the Product, and we never use children's information for advertising or sell it to anyone.
If we learn we have collected personal information from a child without parental consent, we will delete it promptly.

5. Your Family's Data
Your family's data belongs to your family. Specifically:
You own your content. Anything your family creates, uploads, or stores in the Product remains yours.
Limited license to us. You grant us only the license we need to operate the Product for you — to store, process, back up, and display your content to your family. Nothing more.
No surveillance, no ads, no data sales. We do not sell your data, use it for advertising, or profile your family for third parties.
Export and deletion. The Family Administrator may export or delete the family's data at any time. When you delete data or close your account, we will delete it from our systems within a reasonable period, except where the law requires us to retain it.
Our Privacy Policy explains our data practices in more detail and is part of these Terms.
6. Acceptable Use
Please use the Product in the spirit it was built. You agree not to:
Break the law or violate anyone else's rights;
Attempt to access another family's account or data;
Upload malicious code, or probe, scan, or disrupt our systems;
Harass, exploit, or harm anyone — especially children;
Resell or commercially exploit the Product without our written permission;
Reverse engineer the Product except where the law permits it.
We may suspend or terminate accounts that violate these rules. Where a child's safety is involved, we may act immediately and notify the appropriate authorities.
7. AI Features
The Product includes AI-powered features ("Digital Guides" and similar tools). AI output can be inaccurate or incomplete. It is offered to support your family's judgment — not replace it. Please don't rely on AI output as professional advice (medical, legal, financial, or otherwise).
8. Our Content
The Product itself — its software, design, and branding — belongs to FDF or its licensors. We grant you a personal, non-transferable license to use the Product for your family's private, noncommercial use during the beta.
9. Disclaimers
The Product is provided "as is" and "as available," without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. This is beta software offered free of charge by a nonprofit; we cannot promise it will be uninterrupted, error-free, or secure.
10. Limitation of Liability
To the fullest extent permitted by law, FDF and its directors, officers, employees, and volunteers will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, arising from your use of the Product. Our total liability for any claim relating to the Product will not exceed one hundred dollars ($100) or the amount you paid us in the past twelve months, whichever is greater.
Some jurisdictions do not allow certain warranty disclaimers or liability limits, so parts of Sections 9 and 10 may not apply to you.
11. Termination
You may stop using the Product or delete your family account at any time. We may suspend or terminate access for violations of these Terms, for legal reasons, or if we wind down the beta. If we end the beta program, we will give you reasonable notice and an opportunity to export your family's data.
12. Changes to These Terms
We may update these Terms as the Product evolves. If we make material changes, we'll notify you (for example, by email or in-product notice) before they take effect. Continuing to use the Product after changes take effect means you accept the updated Terms.
13. Governing Law and Disputes
These Terms are governed by the laws of the Commonwealth of Virginia, without regard to its conflict-of-laws rules. Any dispute that we can't resolve informally will be brought in the state or federal courts located in Virginia. Before filing anything, please contact us — we'd much rather work it out directly.
14. General
These Terms, together with the Privacy Policy, are the entire agreement between you and FDF regarding the Product. If any provision is found unenforceable, the rest remain in effect. Our failure to enforce a provision is not a waiver of it. You may not assign these Terms; we may assign them in connection with a reorganization of the Foundation.
